Where did my Mascot thread go?

Was my thread about my Mascot idea deleted? If so, why?

It's a damn shame I actually liked the idea a lot and came back on this morning specifically to look in on the thread to see if riven had chimed in. Oh well guess I'm back to not caring about this site.

I did say give it a bootyhole in jest but there is no way you can convince me that the battery slots on an older game controller model is a bad idea. It's tasteful, it fits the theme of the website, and at least a few prominent folks agreed that it was something positive for the site.

Xhin uses filters to block all sorts of unwanted content, like a specific username (in the name or message body), a certain IP (like a soft-ban) or blocking posts from unregistered accounts (with exceptions). At one point he even added 10+ extra filters just to test things out to try to stop unwanted content from getting through. When that didn't work, he locked down the entire site.

You are not the first that was accidentally caught in it, either...

But fuck it, let's drive away more legitimate community discussion and feedback. Just let mguy make his fursona into the community mascot. At this point, it does seem to be mirroring the site owners vision which appears to be to continue to run everyone off that he can.

The site needed a bit of a cooldown on the mascot threads, which I alluded to in my post before locking it.

They've now been variously unlocked, untagged or manually approved from the filter queue.

In the future if you get caught by filters that are related to an ongoing issue there's probably a good reason for it. Instead of trying to bypass it, it makes sense to wait until they're approved through the queue.

If you get caught by a filter in the 30-39 range you're probably not going to get through it and there's a *very* good reason you've been caught by it.

I don't know how many times I need to repeat the same thing, but here it goes again:

1 - The design was never finished. It's still in conceptual/study phase. It hasn't been roughed, yet.
2 - I AM NEVER GOING TO MAKE A BANNER FOR THIS SITE. The amount of work to coordinate a mascot through 12 forum banners is not worth the riots of trolls who think Spongebob and a Dreamcast controller are better options. Nobody wants the project, nobody even understands the project, nobody has ever tried to understand the project, when the option to turn the banners off was presented people were still upset why their personal mascot idea wasn't chosen and blamed me for it, why the hell would I waste any more of my time getting you all a beautiful site for free?

Here's a piece of advice: if you're going to be stupid, don't also be an asshole. Being stupid alone is forgivable, but being stupid and an asshole is really not.

It's not like we're saying steal their logo. A drawing of a controller is 100% in fair use. Again, let's look at B-Mo. He's literally a character modeled after an old-school game boy. Adventure Time didn't get sued for that. Likewise, a Dreamcast controller turned into a character is a unique creation covered in artistic fair use. No one in their right mind would expect to see someone get sued over that.

There's this thing with art called fair use. But you wouldn't know about that.

You can't rely on fair use. Cases can go either way. Parodies have still landed people in hot water.

A drawing of a controller is 100% in fair use.

Ah, so you're the legal expert. Absolutely no lawyer in the country would recommend relying on fair use. That's very shaky grounds. Some people sold works and it was OK. Other people lost their jobs and homes trying to defend cases and get wrapped up in legal fees for ages, even when they're right. Fair use is not a guarantee, and stealing someone else's product design to use as your mascot isn't fair use.

Again, let's look at B-Mo. He's literally a character modeled after an old-school game boy.




You see how these two things do not look that similar? No one will confuse B-Mo for a Gameboy, or Nintendo. But a Dreamcast mascot here paired with a couple hate posts for good measure could be a viable case.

A great writeup about fair use and fanart. Copyright law is very complex and individual to the holder. Some pursue aggressively, while others are more relaxed and lenient. Indie devs are easy to work with, just e-mail the guy and if he gives written permission, then you're OK. As long as the one or two guys are OK with the end result and how it's used, you're fine. Nintendo hired some people to make an animation ad demonstrating parental controls with Bowser, and they were extremely aggressive in how Bowser holds the phone, how Bowser is presented in the ad, the mannerisms permitted, the direction of the project, etc. Disney is notorious for aggressively pursuing people who sell their designs. If you notice, Disney designs are given an upcharge on some T-shirt sites because Disney takes their own fees and they can deject ideas they don't like. They will pursue IPs trying to sell their designs and take their cut and maintain control.

Well, I also don't need to inform you how IPs can cause serious damage to yourself and this site. I'm just doing it because I don't want you to put yourself in danger. If you worked with a reliable expert they will inform you and maybe not put forth or proceed with an idea that would put you at risk. Now that you're not working with me, I can't be so sure. All I can do is inform you. The final decision is yours. Or the community of trolls who insist copying an image of a Dreamcast controller is just fine, whoever decides these things nowadays.

Someone said they thought of an idea in 3 seconds and mocked me for not being able to do the same. No one bothered to correct him on how wrong that was. I'm the only one defending myself, no one else on the site is going to help defend me when people say things like this because no one here can even remotely be considered an expert. At least I know for sure you'd be in the clear with my design.

what does that range block?


It's being used for a set of very custom admin tools that add security beyond what's possible with bans or filters. I'm also not using all of the numbers currently -- some are reserved for future tools.

You shouldn't accidentally get caught in it, but if you are, there's a filter queue that lets me approve those posts (and other filtered ones) easily.

Filters 30-39 are secretive by design so I won't reveal anything else.

This is *extremely* condescending. I wouldn't even say this to people I thought had done something objectively dumb -- I'd instead give them an opportunity to learn, and like ideally teach them in a way that doesnt come off as being a patronizing prick.

I guess in your case you're upset with him, so more ire is coming out.. but have you ever considered that people are attacking you purely because you're behaving this way towards them? People don't like being patronized, and even if you're objectively right about something there's a better way to go about it (unless they were objectively an ass first of course).

He literally doesn't care if the site shuts down and you lose your bank account battling the legal fees.


If GameTalk was selling merch that had copyrighted material than you'd be correct. But using an altered image of a product that has stopped being produced for 20 years will not get the site shut down and Riven sued.

No buts. It's true the high profile cases are always some business sold someone else's IP... there's more money in that. But it happens to non-profits, and non-commercial projects, too. If Sega doesn't want their IPs associated with this site at all, they have a LOT of power to do horrible things. It's a risk Riven has to take on. And I wouldn't be fair to not inform him of that risk.

You are free to draw this mascot character as much as you want. But it can't be used on the site unless Riven is OK with the risk and feels he can cover the fees and win any legal battle with ease. He can still decide it, but I can't just be a bystander and allow it to happen or suggest that I want it to happen because then I could wind up involved as the creator of the mascot. That's why I'm making it very clear I AM NOT designing this Dreamcast controller, I am NOT involved in its creation at all, and I CANNOT recommend it be approved by the site owner.

This might just feel like a small community, but it's still very much a public forum. Sorry to break it to you, but your mascot design is all sorts of legal gray area... some might say very clearly legal black area. I am not a lawyer, but I do not recommend you pursue this design in any official capacity, and I wouldn't waste my time on a design that doesn't look that good anyways.

They can, if they don't agree with the content. If they feel it's damaging the brand. If one day they decide they just decide they want to. It's a risk. And no matter how much you try you won't be able to convince me it isn't a risk, because it's a literal fact that copying a company's IP is always going to be a risk. Every copyright case is a risk, handled on a case-by-case basis, some cases even being overturned by the Supreme Court. There are tons of cases that conflict with each other, no one can tell you with straight face what's good and what's not. The only way is to avoid the drama altogether and come up with something original.

I don't think further responses will change anything.

I don't care enough about this "mascot" in the first place, but can we at least pretend to be reasonable here? If we use a Dreamcast controller, SEGA is almost certainly not going to ever know. And even if they did, and felt this random internet forum with like, 12 people needed to be dealt with, they're not defaulting to a lawsuit. They'd send a cease and desist first.

If we don't want to use the Dremacast controller, that's fine. Genuinely do not care. But we don't need to go down this super paranoid wormhole pretending like Riven is gonna lose his house and everything he owns in a law suit because SEGA is gonna notice in the first place and default to an overreaching law suit.
